    5150: Under the California Welfare and Institutions Code (WIC), a 5150 is a 72-hour involuntary hold for evaluation and treatment of a person with a suspected mental health disorder who is considered a danger to themselves, a danger to others, or gravely disabled (unable to provide for their basic needs of food, clothing, or shelter).


  • 5250

    5250: If, after the initial 72-hour hold (5150), the person is deemed to still be a danger to themselves or others, or remains gravely disabled due to a mental health disorder, a 5250 can be issued. This allows for up to 14 additional days of involuntary hospitalization. The individual has the right to a hearing during this period to contest the hold.

    AB1424: California Assembly Bill AB1424 requires that past mental health history and records be considered when determining if a person should be placed under a 5150 or 5250 hold. This means that information from family members, care providers, or past records, which suggests the individual is likely to become dangerous or gravely disabled, should be taken into account.

  • After calling the police:

    If it is an emergency and the police have been called, meet the police outside the house before talking to the sick person. Briefly describe to the police what happened and the emotional state of the patient. If you can offer helpful advice based on past experience, tell the police "what's best" when dealing with your loved one.


    Before the police arrive, make all preparations. Be sure to remove anything that could be used as a weapon or appear to be a weapon. Be direct and candid when communicating with the police. The description of the current situation does not exaggerate nor omit any relevant information.


    If the police believe that the patient meets one or more of the three conditions listed on the previous page 5150, the police may involuntarily detain the patient under section 5150 and arrange transportation (usually an ambulance) Go to a designated hospital for psychiatric evaluation and treatment. Sick patients may be held involuntarily for up to 72 hours. Always ask the ambulance driver or the police which hospital a friend or relative will be taken to.


    AB 1424 This California law states that when determining whether there is reasonable cause for involuntary hospitalization of a mentally ill patient for up to 72 hours for evaluation and treatment and up to 14 days of additional care, the legal process must take into account the Information about patients with mental disorders.

    If possible, you should fill out the form in advance, update the information from time to time, and keep multiple copies handy at all times. If the police or other professionals need to determine whether your family member should be detained for involuntary treatment (5150), give them a copy of Form AB 1424 to take to psychiatric emergency services. You can also send the form to a medical provider by mail or by fax.
